QUIZWINNERS TERMS AND CONDITIONS

The Terms and Conditions as specified below apply to visitors and users of website QuizWinners.co.uk (hereafter referred to as 'QuizWinners') and of any corresponding websites operated by Keesing Games, as well as the services offered on these websites. Visitors and users (hereafter referred to as 'User') of QuizWinners do automatically, fully and unconditionally agree to these Terms and Conditions and accept these. These Terms and Conditions are binding.

The Terms and Conditions can be changed during the duration of the game, after which the revised Terms and Conditions are applicable to the User. QuizWinners reserves the right to disqualify or ban a person or account (IP-address), when, according to QuizWinners one or several points of these Terms and Conditions are violated. If User does not comply with the Terms and Conditions then he or she will forfeit the prizes as won by him or her. All decisions made by QuizWinners are final and binding.

Should one or more provisions of these Terms and Conditions be nullified, then the remaining provisions will remain valid. In that case, QuizWinners will draw up substitute provision, which will correspond closely to the nullified provisions.

1. Registration

Firstly, the User has to register on the QuizWinners website by means of a personally chosen user name and valid email address before the User is able to take part in the different games and tournaments. This registration is only necessary once. In order to be able to take part in all games and tournaments, win prizes in doing so and be able to collect these prizes the User needs to provide further information for his/her registration in order to collect the prize/prizes. QuizWinners reserves the right at all times to refuse or disqualify a User without providing a reason.

When completed, all details have to be correct and factual. The User is at all times responsible for any changes to these details. The only way QuizWinners is able to pay out prizes is when the User details are correct. It is prohibited to register more than once. Should the User do so, this will result in disqualification. Entering incorrect details may also lead to exclusion from the games and tournaments.

When the User has registered and paid, he or she will be granted immediate access to the games and all other services of QuizWinners. This means that the User cannot refer to the right to cancel the agreement as concluded with QuizWinners within a certain period, nor claim restitution of monies already paid.

2. Responsibilities of the User

To supply his/her true and correct personal details to QuizWinners;
to comply with the rules and the Terms and Conditions;
to have no more than one single (1) combination of QuizWinners user name and email address;
to be at least 18 years of age;
to be able to fulfill the financial responsibilities resulting from using QuizWinners; the User may not be bankrupt, neither now nor in the past;
to be a resident of a state in which the use of QuizWinners is permitted according to the laws of that state, and also to be permitted to access the QuizWinners website from such a state.

QuizWinners, at its own discretion, reserves the right to exclude a person who, in the opinion of QuizWinners alone, is found guilty of falsifying of or tampering with the registration process. QuizWinners also reserves, at all times, the right to exclude a User who in the opinion of QuizWinners is playing unfairly or cheating. This includes, but is not limited to, Users who deliberately underperform in a game in order to obtain a lower ranking which can be used to play against less capable users. QuizWinners considers such actions during the registration process or during games to be a violation of the User Conditions of the website and of the Terms and Conditions. This also applies to any other unacceptable or inappropiate behaviour, such as harassing, abusing, threatening or bullying of other persons or companies.

Employees, agents and management of QuizWinners and its respective parent companies, cooperatives, subsidiaries, advertisers, sponsors, licence holders and executive representatives, close relatives (meaning spouses, children, brothers and sisters, parents or grandparents) and people that are part of the same household, are not authorized to take part in the QuizWinners games. If there is any reasonable doubt with regard to the individual performance, a test at the Keesing Games offices may be part of the procedure for awarding a prize. Any costs resulting from this test are entirely payable by the User in question.

3. Identity of the User

At its sole discretion, QuizWinners reserves the right to decide in case of any argument about who is eligible for winning a prize. As a rule, the authorized holder of the IP account in the registration form in question will be considered as the authorized User account. As the authorized holder of the account is considered the person to whom an email address is allocated by the Internet access provider, a service provider or any other online organization responsible for the allocated email addresses of the domain associated with the email address as stated. All games on QuizWinners are individual games and should be played individually. In case of any reasonable suspicion of a User not complying with this rule, we reserve the right not to pay out any prize or prizes.

4. Computerized playing

The use of machines, computers, software, scripts or any other use of mechanical, macro, automatic or programmed methods is strictly prohibited. Games that are played using any of these will be declared null and void automatically. Violations will result in the full and permanent disqualification of the User and excludes him or her from taking part in all current and future games or features and services as available on the QuizWinners site. Should QuizWinners, at its own discretion, decide that a User violates one or more prohibitions of these Terms and Conditions, then QuizWinners is not obliged to award any prizes as won by these Users. QuizWinners will take all possible measures to protect its website and the quiz against fraudulent and other illegal activities.

5. Privacy

QuizWinners is committed to ensuring the privacy of all its visitors and will observe confidentiality with regard to the personal details as provided to QuizWinners by visitors and users of QuizWinners. “Personal details” means information, which may be associated with a specific person, such as, for example, names, address, phone number, email address, and any information required for the payout of prizes. We observe customers’ statutory rights for making such details known.

Not everybody wishes to divulge personal details, simply because he/she is visiting a website. For that reason, as soon as the User is asked for details regarding the payment of prize money, he or she is also asked whether he/she wishes to receive relevant information concerning prizes and/or new games (opt-in), and is also asked whether he/she would like to receive information from partners and other organizations that are linked to QuizWinners (opt-in). When the User registers, he permits other QuizWinners Users to be able to send him invitations via email for Invitation Tournaments. When a User enters his/her details, the User reserves the right to change his/her mind at a later stage and to change the details entered earlier. Details regarding registered Users will never be used for sales activities by third parties. The User will therefore never receive unsolicited advertisements or emails from third parties through QuizWinners.

QuizWinners considers a good relationship with the User of the highest importance. QuizWinners would like to get to know the User, thus enabling QuizWinners to continue to improve the services it provides. However, it is entirely up to the User to make use of these services or not. Should the User see any reason for assuming that Quizwinners has not complied with these principles, then he or she is requested to contact us. QuizWinners will do everything in its power to assess the problem and rectify it.

The QuizWinners server will automatically record the IP number and domain name of User, as is done on almost every website. The information as collected by QuizWinners in this manner is used, for example, to improve the structure of the website and make navigation easier. The QuizWinners server also offers the User's computer a 'cookie' with limited login data, which means that the User is recognized when he/she visits QuizWinners again. Therefore the User does not have to enter all registration data again. Should the User not wish to be recognized, then the User can configure his/her internet browser in such a manner that cookies are deleted or blocked from the hard disk or that the User is warned every time a cookie is about to be stored.

6. Publicity

By accepting any prize as offered, the winner automatically agrees to publication of the user name as chosen by the User, as well as the amount in prize money and possibly his or her place of residence on the QuizWinners site and/or in any other medium, without any further compensation or reward.

7. Prizes

The prizes are subject to change and, amongst other things, depend on the type of game and participation of other Users. A small part of the total stake in a game goes towards QuizWinners, as payment for matters such as administration costs resulting from organizing the game. The rest of the prize money is paid out to the winner or winners. The User is informed of the appropriate, possible amount of money that can be won or has been won before and/or after the game. At its sole discretion, QuizWinners reserves the right to limit the number of times a User is able to win.
In order to prevent games addiction, a User and/or IP address may :

never win and/or cash in more than £300.00 within a continuous period of 31 days, neither in money nor in Quiz Miles;
in each quiz not win more than one single (1) Progressive Jackpot per entry cost within a period of one month;
cash in no more than once (1 time) per continuous period of 72 hours any prizes he/she has won, neither in money nor in Quiz Miles.

Prizes are transferred to the bank account number as provided by the User within 72 hours of receipt of their request. The prizes are only awarded if, and only if, the details of the User are correct and complete. Payments will only be made to winners. The winners are not allowed to dispose of the prizes they have won, nor are these transferable in any other way. If a User has not received a payout, then QuizWinners should be informed of this through email within 30 days of the request for payout. If the User omits to inform QuizWinners of this within 30 days after the request to pay out, then the User forfeits his/her right and the sum in question will not be paid, nor any other prize awarded.

The minimum amount that a User can request to be paid out is £10. The transaction costs are £1 per payment. Therefore, User's balance when requesting a payout needs to be at least £11.

All payouts are net payments. Should QuizWinners be asked to charge excise and tariff with regard to the payment and/or indicate the value of the payment to the appropriate authorities then these are deducted from the amounts to be paid. All possible local, national taxes, duties or other charges and/or taxes as a result of payment, for example when the User has more than 454 euros in prize money paid out all at once (1 time), are exclusively the responsibility of the User.

Any amount of money that is wrongfully paid out to the User by QuizWinners will be the property of QuizWinners at all times and will be automatically repaid or reversed to QuizWinners without any need for further explanation or notification. Should the User not have sufficient funds available to comply with this then the amount as wrongfully received by User will become a debt immediately due to QuizWinners.

Costs and prizes mentioned in pound sterling are based on the original prizes in euros, taken into account the current exchange rates. When necessary, QuizWinners has the right to change the costs and prizes, based on the exchange rates.

8. Cancellation and irregularities

QuizWinners has the right to postpone or cancel a game at any time and at its sole discretion, should a computer virus, bug, hacking attempt or any other technical problem disorganize or jeopardize the administration, safety of gaming or of the game itself.

9. Copyright and trademark

The QuizWinners website, as part of the corresponding websites that are operated by Keesing Games, web documents, illustrations, images, logos, sound fragments, including software, are all the property of QuizWinners and are as such protected by the existing legislation with regard to copyright and trademark. Any unlawful use or unlawful distribution, disclosure of confidential information or copies of these, both entirely or partly of these websites etc is prohibited.

10. Liability

By visiting and using the QuizWinners website and the corresponding websites operated by Keesing Games or its members or affiliated partners and the services as provided on these websites, the User accepts that neither QuizWinners, its agents and representatives, its parent companies, associated companies, subsidiaries, advertisers, promoters and cooperatives nor legal advisors can be held responsible for or made liable for

attempts by players to falsely demand any prize;
problems with regard to Internet connections, attacks by hackers, line switching or use of dated computers or software, telephone, electronic, hardware or software programmes, network, internet or computer defects and faults or any other problem;
failed, incomplete, distorted computer transmissions;
possible printing or typing errors, online as well as offline, in material with regard to the games;
possible damages, losses or injuries sustained with regard to or as a result of the prize, or acceptance, possession or use of the prize or in relation to participation in the quiz;
late, lost, delayed, damaged, incorrectly sent, incomplete, illegible, unintelligible or unstamped messages, exemption forms, sworn statements or any other correspondence;
Acts of God or circumstances which are outside the control of QuizWinners and which may cause interruption or disorganization of the quiz.

QuizWinners and affiliated companies, subsidiaries, advertisers, promoters and executive companies, legal advisors and other parties involved cannot guarantee that all services and information as supplied on the QuizWinners site, and the corresponding websites as used by HIMES BV or by its members or associated partners are correct and fully functional at all times. QuizWinners cannot be held responsible for any possible shortcomings, losses or errors caused by, either directly or indirectly, any website, including all contents and hyperlinks to other websites that are the property of or administrated by a member or third party. QuizWinners does not accept responsibility for any claims of whatever nature made against it, based on the above-mentioned points.

QuizWinners cannot be held responsible for any problems, including delays, spamming or virus, resulting from the use of email, downloaded material or any other behaviour that originate from a QuizWinners site and the corresponding websites as operated by Keesing Games or its members or associated partners. Neither can QuizWinners be held responsible for possible errors or inaccuracies in information as provided on the websites, either through technical problems because of updating or uploading of information, in case of either a server breakdown at QuizWinners and/or other sites that are the property of or are administrated by its members or associated partners.

QuizWinners does not assume liability for any disruption with regard to the smooth running of events if such a disruption is caused by circumstances beyond the control of QuizWinners or an Act of God, including strikes, disasters, server breakdown, government regulations and other events of any nature that do not come under the control of QuizWinners.

QuizWinners has at all times, and at its own discretion, the right to exclude a User who displays inappropiate or unacceptable behaviour.

11. Applicable law

Should any argument between the parties involved result in a legal procedure and/or proceedings, then this will proceed in compliance to Dutch law.
